- De acuerdo a la Ley Nº 28518, además de las prácticas pre y profesionales, existen el Aprendizaje con Predominio en la Empresa (APE) y la Capacitación Laboral Juvenil.
¿Sabías que además de las prácticas preprofesionales, profesionales y las pasantías, existen otras Modalidades Formativas Laborales? En la siguiente nota, el Ministerio de Trabajo y Promoción del Empleo (MTPE) te cuenta un poco más del Aprendizaje con Predominio en la Empresa y la Capacitación laboral juvenil, modalidades incluidas en la Ley Nº 28518.
Las Modalidades Formativas Laborales te permiten, a través de un convenio con una empresa y/o un Centro de Formación Profesional, capacitarte y mejorar tu empleabilidad laboral, además de acceder a una subvención económica que no debe ser menor al sueldo mínimo vital vigente, equivalente a S/ 1,025. Asimismo, accedes a beneficios como un seguro contra enfermedad y accidentes, un descanso subvencionado de 15 días cuando la modalidad sea superior a 12 meses, entre otros.
Para acceder al Aprendizaje con Predominio en la Empresa (APE) y a la Capacitación Laboral Juvenil (CLJ) no debes estar estudiando alguna carrera universitaria. Específicamente para ser parte del APE debes tener más de 14 años, además de haber culminado el nivel primario como mínimo. Como aprendiz, realizarás el proceso formativo mayoritariamente en la empresa, con espacios programados de aprendizaje en un Centro de Formación Profesional (entidades especializadas autorizados por el Ministerio de Educación o el sector competente).
Por su parte, para acceder a la Capacitación Laboral Juvenil debes tener entre 16 y 23 años. La capacitación se realiza en la misma empresa en la que se trabaja y la duración del convenio debe estar adecuada a la naturaleza de las respectivas ocupaciones: no mayor a 6 meses en ocupaciones de poca calificación, ninguna complejidad y niveles menores de responsabilidad, siendo prorrogable hasta por un periodo similar: y no mayor a 24 meses en ocupaciones que requieren mayor calificación, complejidad y niveles de responsabilidad.
Cabe resaltar que en ambas modalidades, la jornada formativa no debe superar las 8 horas diarias o las 48 horas semanales.
Además, existen las conocidas prácticas pre y profesionales, las cuales se dan durante y al culminar los estudios superiores, respectivamente. En el primer caso, la jornada formativa no debe superar las 6 horas diarias o las 30 horas semanales, mientras que en el caso de las prácticas profesionales, la jornada formativa no debe superar las 8 horas diarias o las 48 horas semanales y el convenio durará como máximo 12 meses.
Por su parte, las pasantías están dirigidas a las personas mayores de 14 años estudiantes de los últimos grados de secundaria, estudiantes del ciclo básico de los Cetpro, Cenforp y de los Centros de Formación Sectorial. En este caso, la jornada formativa no deberá superar las 8 horas diarias o las 48 horas semanales y el tiempo de duración del convenio no debe ser mayor a 3 meses.
