- De acuerdo con la Ley 30412, las personas con discapacidad severa deben hacer valer su derecho presentando el carné amarillo otorgado por el Conadis.

Frente a las constantes denuncias por parte la población con discapacidad, el Consejo Nacional para la Integración de la Persona con Discapacidad (Conadis) recuerda a las empresas de transporte urbano e interurbano que están en la obligación de respetar el pase libre a las personas con discapacidad severa que presenten el carné amarillo.
A través de una jornada de sensibilización realizada en la intersección de la Av. Faucett y Av. La Chalaca, el Conadis, en conjunto con la Municipalidad Provincial del Callao, exhortaron a los transportistas a acatar lo estipulado en la Ley 30412, que dispone la exoneración del pago de dicho servicio a las personas con discapacidad severa que se encuentran inscritas en el Conadis y que portan el carné amarillo al momento de subir a sus unidades.
Multa por incumplimiento
El Conadis precisa que, las empresas de transporte terrestre urbano e interurbano que incumplan esta disposición, pueden ser multadas con el 20% de una UIT, equivalente a S/ 990.00 (novecientos noventa soles). Asimismo, se procederá con la inhabilitación del vehículo para prestar el servicio de transporte público por 05 días.
Además, el conductor del vehículo podría ser inhabilitado para brindar dicho servicio por 30 días; y, como medida preventiva, se retendrá la licencia de conducir.
Cabe resaltar que, en Lima y Callao, la Autoridad de Transporte Urbano para Lima y Callao (ATU) es la entidad que debe cumplir con su función fiscalizadora y sancionadora; mientras que, en regiones, las municipalidades provinciales son las que deben velar por el cumplimiento de la misma.
¿Cómo denunciar?
La persona con discapacidad severa u otra persona que evidenció el incumplimiento de dicha norma puede denunciar el hecho en la comisaría más cercana, presentando evidencias, como el nombre de la empresa de transporte, número de placa, fotos y/o vídeos que agilicen el procedimiento.

Según la Ley Nº 30412, las personas con discapacidad severa pueden hacer uso del pase libre en servicios tales como: Metro de Lima, Metropolitano, corredores complementarios (para Lima), buses y combis (para Lima y regiones), presentando el carné amarillo del Conadis. El beneficio solo aplica para viajes dentro de una misma localidad, a excepción de los viajes de Lima a Callao y viceversa; mas no para viajes interprovinciales.
